When you reserve a yacht or make use of our Service, you consent to these Terms. If you do not agree with any portion of these terms, you should not proceed with accessing the Service.

2. Service Overview

SolarOrchardWay offers exclusive yacht charter services which include, but are not limited to:

  • Yacht hire on a daily basis
  • Cruises at sunset
  • Corporate getaway experiences
  • Private celebrations
  • Multi-day yacht journeys

Our offerings are contingent on their availability and prevailing weather conditions. We hold the right to modify or cease offerings without prior notice.

3. Booking and Reservations

3.1 Booking Process

For a successful yacht booking, you are required to:

  • Be at minimum 18 years of age
  • Submit accurate and complete details
  • Make the necessary deposit according to your booking confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A booking is considered confirmed only after we acknowledge receipt of payment and provide written confirmation. We may refuse service at our discretion.

3.3 Availability

Yacht charters are dependent on the availability of vessels and favorable weather conditions. We will make sincere attempts to fulfill your requested dates and times.

4. Payment Terms

4.1 Pricing

Quoted prices are in € and include applicable taxes unless specified otherwise. Bear in mind that prices may vary and can change without notice.

4.2 Payment Schedule

  • Deposit: 50% of the full cost of the charter is required upon booking
  • Balance: Must be settled 48 hours before the departure of the charter
  • Extra fees (if any): Payable after the charter concludes

4.3 Payment Methods

We accept a variety of payment methods, which include major credit cards, bank transfers, and verified cheques. All payments are processed using secure, encrypted procedures.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • Over 72 hours prior to departure: Complete refund excluding processing charges
  • Between 24 and 72 hours prior to departure: Refund of 50%
  • Under 24 hours prior to departure: No refund is given

5.2 Weather Cancellations

Should our captain consider the weather unsafe, we will propose to:

  • Reschedule your charter to an alternate available date with no extra cost
  • Issue a full refund when rescheduling isn't feasible

5.3 Mechanical Issues

In the event of technical issues with the designated vessel, our goal is to arrange a comparable substitute. If this isn't possible, we will grant a full refund.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

  • Adhere to all instructions from the crew
  • Don safety gear when asked
  • Notify about any health conditions that might influence their security
  • Stay within designated areas on the vessel

6.2 Prohibited Items

Certain items are disallowed on the vessel, including:

  • Containers made of glass
  • Illegal substances
  • Weapons or firearms
  • Excessive beverages beyond moderate consumption
  • Pets unless given prior authorization

6.3 Conduct

Passengers should behave respectfully. A charter may be ended earlier than scheduled without a refund if passengers act in a way that endangers safety or disrupts the experience for others.

7. Liability and Insurance

7.1 Our Liability

Our accountability is confined to the payment made for your charter. We are not liable for:

  • Injuries incurred due to passenger carelessness
  • The loss or damage of personal belongings
  • Indirect or punitive damages, or those involving a consequence of events
  • Delays due to weather or events beyond our influence

7.2 Insurance Coverage

Our operations and vessels are covered under extensive marine insurance. Passengers should ensure their own travel and personal insurance provisions.

7.3 Assumption of Risk

Engaging in our yacht charter services means you understand that marine activities entail inherent dangers and you take responsibility for your safety and well-being.

8. Modifications and Itinerary Changes

We reserve the ability to alter itineraries, routes, or schedules due to weather conditions, safety reasons, or operational demands. We will do our best to deliver comparable alternative experiences if changes occur.

9. Force Majeure

We're not accountable for any delays, cancellations, or changes that arise from situations out of our control, which include, but are not limited to:

  • Extreme weather events
  • Natural calamities
  • Government directives
  • Port shutdowns
  • Vessel malfunctions

10. Privacy and Data Protection

The handling of your private data adheres to the stipulations of our Privacy Policy. By utilizing our service, you agree to the gathering and usage of your information as detailed in the Privacy Policy.

11. Intellectual Property
